mypropertybank.com is a real estate marketing platform service that enables its users to buy and sell real estate properties and unit shares of a property as asset investments. Users can use the platform to create and sponsor property advertisements to sell real estate properties of their own or other properties they have legal authorisation to sell. Other users reply to these advertisements and the two users can agree to meet with mypropertybank.com to complete the trade through our trading market. In order for users to sell a property, they ("Seller") must provide and store the property documents information in the mypropertybank.com market and provide any pre-documentation and pay any fee associated with the property sponsored from their wallet account. In order for users to buy a property, the (“Buyer”) must be a member of the trading market. A user ("Buyer") must confirm and verify all documents of the property before making payment. All trades on this site are conducted between users of the service. mypropertybank.com provides the service of a property administrator for all co-owned property investments which can be collectively bought and held as asset investments by members on the platform. Acting as an escrow provider, mypropertybank.com is not itself a party of any property transactions conducted by its users.
THESE TERMS INCLUDE, AMONG OTHER THINGS, YOUR AUTHORIZATION FOR DEBITS AND CREDITS FROM AND TO YOUR BANK ACCOUNT (AS DEFINED BELOW) AND A BINDING ARBITRATION PROVISION CONTAINING A CLASS ACTION WAIVER.
YOUR CONSENT TO USE ELECTRONIC SIGNATURES AND COMMUNICATIONS
YOUR CONSENT. To the extent permitted by applicable law, you consent to use electronic signatures and to electronically receive all records, notices, statements, communications, and other items for all services provided to you under these Terms and in connection with your relationship with us (collectively, "Communications") that we may otherwise be required to send or provide you in paper form (e.g., by mail). By accepting and agreeing to these Terms electronically, you represent that: (1) you have read and understand this consent to use electronic signatures and to receive Communications electronically; (2) you satisfy the minimum hardware and software requirements specified below; and (3) your consent will remain in effect until you withdraw your consent as specified. YOUR RIGHT TO WITHDRAW YOUR CONSENT. Your consent to receive Communications electronically will remain in effect until you withdraw it. If you withdraw your consent to receive Communications electronically, you have terminated your mypropertybank.com membership; we will close your mypropertybank.com Account and return the available balance in your mypropertybank.com Account to your Bank Account. If you have any co-owned property investment on the trading platform, you are required to liquidate such investments at the current market price immediately or wait for your property investment maturity in accordance with the terms and conditions that guide the process of asset investment liquidation before you request to cancel your membership. Upon the liquidation of the property investment, the proceed your asset investment will be remitted to your bank account provided in the platform as set forth in these Terms, and you will no longer be able to use your mypropertybank.com Account or the Services, except as expressly provided in these Terms. Any withdrawal of your consent to receive Communications electronically will be effective only after we have a reasonable period of time to process your withdrawal. Please note that withdrawal of your consent to receive Communications electronically will not apply to Communications electronically provided by us to you before the withdrawal of your consent becomes effective.
YOU MUST KEEP YOUR CONTACT INFORMATION CURRENT WITH US. In order to ensure that we are able to provide Communications to you electronically, you must notify us of any change in your email address and your mobile device number or other text message address by updating your profile on the Website.
COPIES OF COMMUNICATIONS. You should print and save and/or electronically store a copy of all communications that we send to you electronically.
HARDWARE AND SOFTWARE REQUIREMENTS. You agree that you will not receive interest or other earnings on the funds in your mypropertybank.com Account. You irrevocably transfer and assign to mypropertybank.com any and all rights that you may have to any interest that may accrue on funds held in your mypropertybank.com Account. This assignment applies only to interest earned on the funds held in your mypropertybank.com Account, and nothing in these Terms grants mypropertybank.com any rights to the principal of the funds held in your mypropertybank.com Account.
PROPERTY ASSET INVESTMENT INFORMATION DETAILS
You agree that mypropertybank.com trading market provide members who are property agents and property owners to offer their available properties for sale and you may view such property details together with other content hosted and developed by us. Members who are property agents, property owners are responsible for preparing the details, documents, and reports in the sponsoring of properties on the mypropertybank.com trading market. mypropertybank.com conducts first level documentation and valuation on the property documents sponsored by members on the market. All property transactions are conducted between members of the mypropertybank.com.
You agree that the property investment details are hosted by us in good faith and are produced directly by members who are real estate agents, property owners and we try as much as possible to make sure that it is accurate. However, you agree that you are responsible for making your own enquiries and verification, confirm the accuracy of all information provided before making any purchase through the platform. We provide no guarantee and accept no responsibility for the accuracy or completeness of any information contained within the details of any property on the trading market platform and for any loss arising from such property traded. You are responsible for making appointments with us and our property representatives, checking on property, making property visitation report, conducting a property search report, confirming and satisfying yourself as to the accuracy of any details. REAL ESTATE PROPERTY CATEGORIES AND TRADING RIGHTS
You agree that mypropertybank.com trading platform provides two classes of real estate asset investments: (A) INDIVIDUAL PROPERTY OWNER and (B) COLLECTIVE OWNED (CO-OWN) PROPERTY ASSET INVESTMENTS.
(A) INDIVIDUAL PROPERTY OWNER OFFER: This is a property asset can only be acquired exclusively by a member from the market platform. Class A property ownership title is transferred from the seller to the buyer of the real estate property in the trading market. The buyer of this class of real estate asset takes full ownership of such assets from the platform completely. This type of property transaction is conducted between members on the trading market. This Class of property are not automatically tradable on the trading market. However, this class of asset investments can be traded on the platform upon application of property sponsorship by the owner of such Asset and subsequent approval by the company on the trading market.
(B) COLLECTIVE OWNED (CO-OWN) PROPERTY INVESTMENTS OFFER: In the Class of property investment, many members agrees to acquire a part share units of a real estate property according to their funding ability with the sole aim of reselling such property investment upon maturity as stated in the property investment plan. The property co-owners are entitled to the percentage share per units of the property investment purchased in such real estate investment. This irrevocable Authorization is solely for the purpose of enabling all co-owners of the property Asset receive the sales proceed as return on investments. In this regard, property asset Co-owners agree waive all right of ownership on the property investment upon maturity and give same right to the Company and its third party service provides to sell such property investment held.
For purposes of such authorization, you hereby grant mypropertybank.com and our third-party service providers a full power of attorney, and you hereby appoint mypropertybank.com and our third-party service providers as your true and lawful attorney-in-fact and agent, with full power of substitution and substitution, for you and in your name, place, and stead, in any and all capacities such as to take possession of the property ownership title and documents in its name; manage the property during the period before the specific date of maturity; can opt to develop such property through collective funding from new investors if available who become additional new co-owners of the property for the security of the property investment at the sole discretion of mypropertybank.com. YOU ACKNOWLEDGE AND AGREE THAT WHEN mypropertybank.com OR OUR THIRD-PARTY SERVICE PROVIDERS CARRY OUT PROPERTY SALES, mypropertybank.com AND OUR THIRD-PARTY SERVICE PROVIDERS ARE ACTING AS YOUR AGENT, AND NOT THE AGENT OR ON BEHALF OF THE THIRD PARTY. You agree that other third parties shall be entitled to rely on the foregoing authorization, agency, and power of attorney granted by you. MEMBERS WAIVES ALL ACTION AND ALL CLAIMS AGAINST COMPANY, mypropertybank.com, ITS THIRD PARTY SERVICE PROVIDERS FOR ANY ACT OR OMISSION RELATING TO OR ARISING FROM THE USE OF THE SERVICES, THE AGREEMENT, OR IN CONDUCTING OF ITS AUTHORISED REAL ESTATE ADMINISTRATIVE ROLE ON CO-OWNED PROPERTY SALES AT MATURITY THAT MIGHT GIVE RISE TO THE CAUSE OF ACTION.
In accordance with this agreement, you agree that during the period while you are a Member, and for three calendar years following resignation, or termination of your membership, you will not encourage, solicit, or otherwise attempt to recruit or persuade any other Member to compete with the business of Company.
PROPERTY SPONSORSHIP APPLICATION
You agree that by submitting your property sponsorship application, you are responsible for all the cost associated of the property verification and documentation process. You agree that unless otherwise specified such fees are automatically deducted from your mypropertybank.com wallet balance or deposit at the time when you made the property sponsorship application. You agree that my propertybank.com can request for property document search reports on the property sponsored and personal identifications documents and information. You agree that mypropertybank.com reserves the right at its sole discretion to approve, disapprove or suspend a sponsored property applications made on the mypropertybank.com trading platform for risk management and security reasons.
We will normally give you a notice of any approval, suspension, or disapproval of your property sponsorship application but we may, if it is reasonable to do so to (for example we consider it advisable for security reasons; if the proposed price of the property is disproportionate to the real value of property or other ownership legal title issues of the property), approve, suspend or disapprove your property sponsorship application without prior notice to you.
You acknowledge that our decision to approve, suspend, or disapprove your property sponsorship application, may be based on confidential criteria that are essential to our risk management and security protocols aim to protect the collective interest of our member community and that we are under no obligation to disclose the details of our risk management and security procedures to you.
In the event that we suspend or disapprove your property sponsorship application, we will lift the suspension as soon as possible once the reasons for the suspension or termination no longer exist.
COMPLIANCE TRADE PRACTICE
You agree that in the course of trading on the platform, you will not circumvent mypropertybank.com to solicit, encourage, negotiate, or conclude any property approved on mypropertybank.com or accept to or make payment for property asset approved on mypropertybank.com without the knowledge of mypropertybank.com. As a property sponsor, you agree that you will always make yourself available for all enquiries and visitation appointments requested by mypropertybank.com and members interested in buying the sponsored property. As an interested buyer, you agree that you are solely responsible for all verification and confirmation of all properties purchased by you. You agree that the trading platform or the company is not liable and accountable to you for any loss associated with any property purchased by you through the mypropertybak.com platform. You agree to defend, and indemnify mypropertybank.com, or the company from and against any and all claims, suits, liabilities, damages (actual and consequential), losses, fines, penalties, costs, and expenses (including reasonable attorneys’ fees) arising from or in any way related to any claims on the property or against the property bought or sold by you through the mypropertybank.com market. You agree that your indemnity to us for any property sold or purchased by you survives the termination of this agreement.
PROPERTY VISITATION REPORT
You agree that if you are buying a property asset available in mypropertybank.com trading market, you should contact and make appointments with mypropertybank.com on the specific property asset. My propertybank.com will approves such appointment and provide you the opportunity to carry out property visitations on the interested property to verify and satisfy all concerns with regard to such property. You are required to make Property Visitation Reports on each visitation occasion on the proposed property on mypropertybank.com before concluding a transaction on the trading market. This is to make sure that all trading of property asset investments on mypropertybank.com is reliable, transparent and verified before property sales. You agree to conduct all trading activities in a professional manner and in accordance with our trade compliance practice.
If a member wishes to bring an action against Company for any act or omission relating to or arising from the Agreement, such action must be brought within one year from the date of the alleged conduct giving rise to the cause of action. You agree to waive all claims that any other statutes of limitations apply.
All payments to Company for subscription, registration, purchases and trade investments are non-refundable as you are granted immediate access to the service or products you have registered for on mypropertybank.com at any time. You agree that the nature of the service and the immediacy of the benefits make any possibility for a refund period commercially impractical. You understand and agree that all payments and purchases are non-refundable.
REMMITANCE OF EARNINGS
All earnings from the trading market are paid into the mypropertybak.com wallet account of members. Withdrawal request are to be made for payment of fund into an individual bank account.
FEES AND PRICING
You become a member by registering to have access to our trading and marketing platform. Your registration to access our platform indicates you completely agree with our terms and conditions. When you click to make a registration with us, legal obligations arise and your right to refund of monies charged to your debit or credit card or paid in any other way agreed by us, are limited by our terms & conditions. The services are provided to you against fees determined per transaction and/or per trade basis in accordance with the prices and pricing principles set out on our website. Company reserves the right to terminate a Member Agreement at any time. The Company can opt to give 30 days’ notice if the Company elects to: (1) cease business operations; (2) dissolve as a business entity; or (3) terminate the distribution of its product and services. Member may cancel this Agreement at any time, and for any reason, upon written notice to QUESTBRIDGE at its principal business address. Company may also take actions short of termination of the Agreement, if a Member breaches any of its provisions.

In the event of a conflict between any Additional Terms and these Terms, these Terms will control.

DISPUTE RESOLUTION BY BINDING ARBITRATION/ JURY TRIAL WAIVER/ CLASS ACTION WAIVER.
For any and all controversies, disputes, demands, claims, or causes of action between you and us (including the interpretation and scope of this Section and the arbitrability of the controversy, dispute, demand, claim, or cause of action) relating to the Services or these Terms (as well as any related or prior agreement that you may have had with us), you and we agree to resolve any such controversy, dispute, demand, claim, or cause of action exclusively through binding and confidential arbitration. A request for interim measures will not be deemed a waiver of the obligation to arbitrate.

You and we must abide by the following rules: (A) ANY CLAIMS BROUGHT BY YOU OR US MUST BE BROUGHT IN THE PARTY’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING; (B) THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS, MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING, AND MAY NOT AWARD CLASS-WIDE RELIEF; (c) such action must be brought within one year from the date of the alleged conduct giving rise to the cause of action (b) the arbitrator will honor claims of privilege and privacy recognized at law; (c) the arbitration will be confidential, and neither you nor we may disclose the existence, content, or results of any arbitration, except as may be required by applicable law or for purposes of enforcement of the arbitration award; (d) subject to the limitation of liability provisions of these Terms, the arbitrator may award any individual relief or individual remedies that are expressly permitted by applicable law; and (e) each party will pay its own attorneys’ fees and expenses, unless there is a statutory provision that requires the prevailing party to be paid its fees and litigation expenses and the arbitrator awards such attorneys’ fees and expenses to the prevailing party, and, in such instance, the fees and costs awarded will be determined by the applicable law. This Section will survive termination of your mypropertybank.com Account and these Terms as well as any voluntary payment of any debt in full by you or any bankruptcy by you or us. With the exception of subparts (a) and (b) of this Section (prohibiting arbitration on a class or collective basis), if any part of this arbitration provision is deemed to be invalid, unenforceable, or illegal, or otherwise conflicts with the Rules and Procedures, then the balance of this arbitration provision will remain in effect and will be construed in accordance with its terms as if the invalid, unenforceable, illegal, or conflicting part was not contained herein. This agreement to arbitrate shall survive any termination or expiration of the Agreement. Nothing in the Agreement shall prevent Company from applying to and obtaining from any court having jurisdiction a writ of attachment, garnishment, interim injunction, interlocutory injunction, perpetual injunction or other equitable relief available to safeguard and protect its interest prior to, during or following the filing of any arbitration or other proceeding or pending the rendition of a decision or award in connection with any arbitration or other proceeding.
We may add to, modify or withdraw, temporarily or permanently or terminate any of the Services or amend these Terms at any time, in our sole discretion, without providing notice to you, you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website. We reserve the right, subject to applicable law, to deliver to you any notice of changes to existing terms or the addition of new terms by posting an updated version of these Terms on the Website or delivering notice thereof to you electronically. You are free to decide whether or not to accept a revised version of these Terms, but accepting these Terms, as revised, is required for you to continue accessing or using the Services.
